This civil action was brought to recover damages for injuries alleged to have been sustained as a result of consuming a portion of the contents of a bottle of Coca-Cola alleged to have been adulterated by the presence of a foreign substance. The complaint is in three counts, counts 1 and 2 charging the defendant with negligence and count 3 charging the defendant with a breach of an implied warranty of fitness for human consumption...
