This cause is in this court on appeal from a judgment of the trial court upon a verdict by a jury finding defendant guilty of failing to obey the lawful orders of a policeman engaged in the performance of his duty at the scene of an emergency contrary to R. C. 2923.43.

The defendant filed his notice of appeal and assigned the following errors:
