BROOM, Justice:

The appellant, in a justice of the peace court, was convicted of driving while under the influence of intoxicating liquor. He appealed to the Circuit Court of Rankin County where he again was convicted and from said conviction he now appeals to this Court.

On December 19, 1971, the Mississippi Highway Patrol, together with a constable, had set up a drivers' license roadblock to check drivers' licenses...
