Lemont Pierce, herein referred to as defendant, and two others, Robert Berry and Walter Caffey, were indicted for the murder of Jake Jones, Jr. Pierce and Berry were jointly tried by a jury in the circuit court of Cook County which acquitted Berry but found Pierce guilty of voluntary manslaughter.
