Harvey E. Moore sued Clarence A. Butler for personal injuries incurred as the result of a fall while plaintiff was assisting defendant in the maintenance of electrical wiring in the defendant's home. In order to perform the work, it was necessary for plaintiff to enter the attic of the defendant's residence by way of a disappearing, spring-loaded stairway, which was so constructed as to pull down from the ceiling when access thereto is desired.
