Tempesta was found guilty of rape by a Superior Court judge sitting without a jury. The case is before us on Tempesta's bill of exceptions to rulings allowing an in-court identification by the victim, and to the admission of certain evidence. Facts which the trial judge could have found on the evidence are summarized.
