For the reasons assigned in State of Louisiana, through the Department of Highways v. Allen Pommier, 270 So.2d 274, decided this date, bearing docket number 4038 of this Court, the judgment of the district court in the instant case is remanded to the district court for further proceedings consistent with the views expressed therein. Costs to await final determination of the case.
