On November 7, 1969, James Bunch purchased a Kenworth truck from Signal Oil and Gas Company, d/b/a Mack Trucks, Inc. On the bill of sale, the truck was represented as a 1962 model, "as is," with a broken crankshaft. After entering into a sales agreement with Bunch, Mack Trucks found it was unable to furnish Bunch with a certificate of title.
