Defendant has moved to correct a sentence imposed upon him for a narcotic violation as illegal. F.R.Cr.P. 35.

After a plea of guilty to distribution of heroin in violation of 21 U.S.C. § 841 (a)(1), defendant was sentenced on November 19, 1971 to five years imprisonment subject to the early parole eligibility as provided in 18 U.S.C. § 4208 (a)(2). He subsequently moved for the reduction of sentence...
