In this case we consider the sufficiency of the evidence to sustain a novation.

Whiting-Turner Contracting Company, Inc. (Whiting), a prime contractor, contracted with H. Max Ammerman and others constituting partnerships trading as Tyson's Corner Regional Shopping Center and/or Tyson's Triangle Limited Partnership (Tyson's Corner or Owners) for the construction of certain stores in a shopping center at Tyson's Corner, Virginia.
