Defendant Bernard Crater was the owner of a 1967 Plymouth automobile that in the early morning hours of September 26, 1967, was being operated by defendant Robert Smith. Defendant Crater's 17-year-old daughter was given permission to use the family car until midnight for the purpose of driving her younger brother to a fair.
