In the early morning of December 26, 1968, the appellant, Mark Steven Hainds, age nineteen, accompanied by two other young men, was hitchhiking at or near Warrenton, Virginia. The three hitchhikers were picked up by William Ellis, the decedent, who drove them to Buffalo, New York, where the other two hitchhikers disembarked.
