This is a criminal action in which Calvin Johnson (defendant-appellant) was convicted by a jury of murder in the first degree (K.S.A. 21-401, now K.S.A. 1971 Supp. 21-3401) and sentenced to a term of life imprisonment in the Kansas State Penitentiary. At the time of the offense charged herein, defendant was serving two life sentences for two previous convictions...
