Shortly after midnight on May 28, 1967, the dead body of Catherine McMenamin was discovered lying on the ground near Roxborough High School in Philadelphia. The appellant, Withers Ponton, was later indicted for her murder, and after a jury trial was found guilty of murder in the first degree.
