In this case plaintiff Harper questions the constitutionality of that portion of the Alabama Democratic Party Executive Committee's Resolution adopted January 29, 1972, in which it is established that in order for an individual to become a candidate in the forthcoming Democratic primary he must first pay a qualifying fee to the Party.1 The Resolution at issue was promulgated pursuant to Title 17...
