We are confronted with the anomalous situation of a government agency claiming a zoning amendment, adopted by it, is invalid because of the alleged failure of one of its officials to perform a statutory duty, namely, publish notice of hearing on the proposed amendment. Plaintiff appeals as of right from the trial court's decision ruling the zoning ordinance invalid.
