This is an interlocutory appeal from an order of the Circuit Court of Taylor County, Florida, dismissing the amended complaint for specific performance against the appellee. This order was based upon a motion to dismiss filed by the appellee, who was one of several defendants in the suit. The other defendants had filed answers and did not contest the sufficiency of the complaint by motion.
