SPENCER, Justice.

Defendant appeals from the denial of an evidentiary hearing on his motion for post conviction relief. Defendant was convicted of motor vehicle homicide. He elected not to appeal and was sentenced to a term of 8 to 10 years in the Nebraska Penal and Correctional Complex. Defendant was represented by counsel of his own choice. The record of the trial is a part of the record herein. We affirm.
