TOLEDO, District Judge.

This cause is before us on a Motion to Dismiss filed on March 15, 1972, by codefendants Walid Warwar and Mayra Egues.1 Said motion requests the dismissal of those counts of the Indictment which relate to Title 21, United States Code, Section 841(a) (1).2
