The seven petitioners were all tried together and each was convicted of violation of Penal Code sections 415 (disturbing the peace), 408 (illegal assembly), and 409 (failure to disperse). After the verdicts of conviction, the petitioners filed a timely application with the superior court alleging their indigency and requesting that the transcript of the trial be provided at public expense.
