The appellant James Henry Moore was convicted by Judge Charles D. Harris, sitting non-jury in the Criminal Court of Baltimore, of murder in the second degree and sentenced to fifteen years in prison under indictment number 192. At the same time he was also convicted of a violation of Maryland Code, Article 27, Section 35A (child abuse) and sentenced to ten years in prison under indictment number 193.
