CHASEZ, Judge.

Plaintiff, Novelty Enterprises, Inc. instituted this action against defendant, Herrin Transportation Co., Inc., to recover $1,000.00 for damages allegedly caused by defendant in transporting amusement equipment known as "The Kiddy Boat Ride". Defendant has, subsequent to the time of damage, been taken over by the McLean Trucking Company, which is therefore made party to this action.
