This is an appeal from the dismissal of the appellant's petition for relief instituted pursuant to 14 M.R.S.A. § 5502 (post-conviction habeas corpus).

The appellant was indicted for a violation of 17 M.R.S.A. § 1601 (cheating by false pretenses) and, following a jury trial, was convicted. The petitioner retained counsel at the time of his original arrest on the charge some four months prior to trial, and the attorney so retained...
