Tennyson, on December 7, 1970, filed a petition for a writ of habeas corpus directed to his former wife, Jane Kinsey Tennyson, in an attempt to recover the physical custody of his five year old son, John Gentry Tennyson. Plaintiff's right to custody was based on a judgment of the Court of Domestic Relations No. Two of Harris County, Texas, which had awarded plaintiff custody of his son on November 4, 1970.
