TOADVINE v. LUFFMAN

No. 407, September Term, 1971.

14 Md. App. 333 (1972)

286 A.2d 790

VIRGIL F. TOADVINE, JR. AND VESTA I. TOADVINE, T/A VIRGIL TOADVINE & SON ET AL. v. BARBARA ANN LUFFMAN ET AL.

Court of Special Appeals of Maryland.

Decided February 4, 1972.

Attorney(s) appearing for the Case

Glenn C. Parker, with whom were Theodore B. Cornblatt and Smith, Somerville & Case on the brief, for appellants.

George H. White and Wade H. Insley, III, with whom were Porter, Cullen, Clark & White on the brief, for appellees.

The cause was argued before MURPHY, C.J., and MORTON and ORTH, JJ.

ORTH, J., delivered the opinion of the Court.

The question presented on this appeal is whether the Circuit Court for Wicomico County erred in confirming the decision of the Workmen's Compensation Commission that two minor children were totally dependent for their support upon their father at the time he died from an accidental personal injury arising out of and in the course of his employment. The only issue involved is the total dependency of the children.
