MORTON v. McCRACKEN

No. 72-639.

269 So.2d 57 (1972)

John W. MORTON, Appellant, v. J.F. McCRACKEN, As Clerk of the Criminal Court of Record of Dade County, and Richard E. Gerstein, As State Attorney of the Eleventh Judicial Circuit in and for Dade County, Florida, Appellees.

District Court of Appeal of Florida, Third District.

November 21, 1972.

Attorney(s) appearing for the Case

John W. Morton, in pro. per.

Richard E. Gerstein, State's Atty., and Milton Robbins, Asst. State's Atty., Hubbard & Hickey, Coral Gables, for appellees.

Before BARKDULL, C.J., and PEARSON and CHARLES CARROLL, JJ.

PER CURIAM.

The appellant, in proper person, has appealed a final judgment dismissing his alleged cause of action against the appellees. Our review of the record affirmatively shows that appellant's complaint in the trial court failed to state a cause of action and that the judgment of which appellant complains was regularly entered.
