This is an appeal from a judgment of the Court of Common Pleas of Preble County permanently enjoining the defendant, Dayton Motorcycle Club, Inc., appellant herein, from using certain land for the purpose of promoting motorcycling and conducting motorcycle races.

The cause was submitted to the trial court upon stipulations of fact which read as follows:

"1. That the defendant, Dayton Motorcyle Club, Inc., is a non-profit corporation organized...
