CLAPP, J., delivered the opinion of the Court.

In this case appellee, Joseph R. Mueller, Jr., recovered a judgment against appellant in the amount of $3,500.00 for personal injuries arising out of an automobile accident on Liberty Heights Avenue in Baltimore City. The judgment of the trial court was affirmed by the Court of Special Appeals in Clayborne v. Mueller, 13 Md.App. 530, 284 A.2d 24
