MR. CHIEF JUSTICE UNDERWOOD delivered the opinion of the court:

Defendant, Ezell Rodgers, was convicted of murder, attempted murder and armed robbery in a Cook County circuit court jury trial and was sentenced to concurrent penitentiary terms of from 75 to 100 years, 19 to 20 years and 20 to 40 years, respectively. The appellate court affirmed the convictions (People v. Rodgers (1972), 3 Ill.App.3d 85
