The Township of Summit is seeking to levy a special assessment to construct a sanitary sewer. The plaintiffs are property owners affected by the assessment. The plaintiffs brought this action seeking to set aside the assessment. The trial court granted the defendants' motion for summary judgment. We reverse and remand.
