In this case, narcotics were seized from the automobile of the defendant, Jackie Lee McNeill, pursuant to a search warrant based upon an affidavit made by a police officer. On the strength of the narcotics so seized, the defendant was convicted of possession of marijuana with intent to distribute, and his punishment was fixed at two years in the penitentiary.
