Defendant-appellant Waldo was charged with two others, Oden and Puett, in a 4-count indictment. The first count alleged conspiracy in violation of 18 U.S.C. § 371 to defraud by means of interstate wire communications as forbidden by 18 U.S.C. § 1343.
