In July of 1970 the district court granted the motion of appellee Barge Sun Coaster for summary judgment, and entered an order dismissing with prejudice the libel claim of appellant Port Laudania Terminal, Inc. (Laudania) for dockage charges allegedly owed by the owners of the barge, Dyer Associates (Dyer).1 An appeal from that order was dismissed by this court in December of 1970...
