In late 1969 a check for $2,500,000 was delivered to the defendant pursuant to the terms of an agreement under which it was to act as an escrow agent. When the defendant discovered that the check bore an allegedly forged endorsement, it stopped payment on certain other checks representing disbursements to beneficiaries of the escrow agreement.
