The appellant, H. Rap Brown, was convicted of violating Title 15, U.S.C., Section 902(e), and sentenced to five years imprisonment and a fine of $2,000.00. Upon direct appeal, this Court vacated the judgment below and remanded the case for a hearing consistent with Alderman v. United States, 1969, 394 U.S. 165, 89 S.Ct. 961, 22 L.Ed.2d 176. Brown v.
