KELLEY, Justice.

Edward John Husar and Norman James Kohn were found guilty of conspiracy to commit grand theft and were sentenced to the penitentiary. A third person, Gerald David Gimm, jointly charged as a co-conspirator with the defendants, entered a plea of nolo contendere to the charge of attempt to commit grand theft and his conviction is not before us.
