Eleven days after the complaint was filed the district court dismissed plaintiffs' entire case on the merits. Their complaint, filed on May 7, 1971, alleged that they had signed a contract to purchase a cooperative apartment for $35,000 and made an earnest money deposit of $3,500, but were thereafter refused admission to the cooperative because a Negro child lived with them.
