This appeal is from an order, D.C., 333 F.Supp. 242, granting summary judgment in favor of the defendant in a patent infringement action. In 1966, appellant Sampson was granted Patent No. 3,233,512 for an educational device entitled "Complete Technological Modernization of Education."
