1. The offense of burglary, of which the defendant was charged, was committed August 29, 1969. He was indicted June 1, 1970, while he was serving time in a Federal Penitentiary in Tallahassee, Florida, to which he had been committed in the early part of 1970. He was paroled from the U. S.
