BUSSEY, Presiding Judge:

Appellant, William Covert Graham, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Oklahoma County, Oklahoma, for the offense of Possession of Marijuana; his punishment was fixed at five (5) years imprisonment and a Five Thousand ($5,000.00) Dollar fine. This cause was reviewed by this Court and an Opinion was rendered on June 30, 1971 ordering the case...
