OPINION
NYE, Chief Justice.
This was a suit by holder of a check against the drawer after payment of the check had been stopped. The drawer filed exceptions to the plaintiff's petition, contending that the payee-indorser of the check was a necessary party to the suit. Upon the holder's refusal to make the payee-indorser a party, the trial court dismissed plaintiff's suit. Whereupon, the holder appealed to this Court.
