The defendant, Ollie Moore, was indicted and charged with murder. Upon a plea of guilty and the waiver of a jury trial, he was found guilty on September 13, 1967, as to the lesser included offense of voluntary manslaughter, and sentenced to serve not less than five nor more than fourteen years in the penitentiary.
