HOLMAN, Judge.
The indictment in this case charged defendant with the offense of murder in the first degree. It was alleged that he shot and killed Lynda Walker on February 6, 1970. A trial resulted in a verdict of guilty and the death penalty was assessed. See §§ 559.010 and 559.030.
