After trial by jury, appellant was found guilty of burglary in the second degree under HRS § 726-1.

The occurrence for which appellant was prosecuted took place in one of the guest rooms of the Waikikian Hotel in Honolulu on January 20, 1970. Testimony at trial revealed the following facts.
