This case involves the interpretation and construction of Section 39-2017, Tennessee Code Annotated, as amended by Chapter 167, Public Acts of 1971:

"39-2017. Lottery — Penalty. — Any person who makes or aids in making, draws or aids in drawing, or is in any way interested or concerned in the making or drawing of any lottery, under any pretense whatever, is guilty of a misdemeanor, and, upon conviction...
