PAOLINO, Justice.

In July, 1964 the defendant was arrested on a charge of assault and battery. After he was found guilty in the District Court he appealed to the Superior Court where he was arraigned on October 14, 1964. After many continuances and hearings on various motions filed by the defendant a trial de novo began before a justice of the Superior Court sitting with a jury. The jury found him guilty. His motion for a new trial having been denied...
