LARSON, District Judge.

Defendant was indicted on September 29, 1971, for two separate violations of the Selective Service Act of 1967, 50 App.U.S.C. § 462. Defendant was charged with:

1. Failing to comply with an order of his local board to report for and submit to a physical examination; and 2. Failing to comply with an order of his local board to report for and submit to induction into the Armed Forces....
