HALL, Justice.

At all times pertinent to this cause, the plaintiff-appellee. Charles D. Nelson, was the owner of a building located in Corsicana, Texas, and a substantial amount of equipment and furnishings in the building that was used in the restaurant business. On June 27, 1969, plaintiff leased the building and the equipment to Meredith Twomey, the wife of Tommy L. Twomey. In the written lease agreement. Mrs. Twomey agreed to "carry fire, theft...
