Bob Braswell, plaintiff, brought an action for damages against defendant J. Lloyd Abbot and Flaco Corporation as a result of mud and water washing onto his property in Mobile County. Flaco was given the affirmative charge and the case went to the jury against Abbot on counts 4-A and 5-B, as amended. The jury returned a verdict in favor of the plaintiff for $12,500.
