The defendant was convicted of breaking and entering in the nighttime on or about April 19, 1970, a building belonging to Poma Aerial Tramway, Inc. in which personal property, the subject of larceny, was then and there situated with intent to commit larceny, in violation of 13 V.S.A. § 1201.

Trial by jury on March 25, 1971, in the District Court of Vermont, Unit No. 6, Windsor Circuit, resulted in a verdict of guilty. Sentence...
